The opinion of the court was delivered by This is an action for injunction brought in the name of the state to restrain the enforcement of an order of the county superintendents of public instruction of Lyon and Coffey counties altering the boundaries of Joint School District No. 1 of Lyon and Coffey counties. The action is brought against the state superintendent of public instruction, the county superintendents of Lyon and Coffey counties, and Joint School District No. 1 of Lyon and Coffey counties. Motion to quash service of summons on the state superintendent of public instruction was sustained and he is no longer a party to this action. Issues were joined and the case tried by the district court. From its judgment granting the injunction, defendants (county superintendents and joint school district) appeal.
